    Default Government to step into States and enforce one call

    Has anyone heard about the US Government stepping in to enforce one call practices? I was looking into some of the ramifications, and it seems the great political beast has every right to do so. Have any rumors been flying around about this?

    This was part of a proposed PHMSA rule regarding effective damage prevention and enforcement laws. PHMSA prepared a NPRM that indicated that they could / would step in and perform enforcement in states where the one call laws do not effectively address and enforce the one call law. This enforcement activity is limited to regulated gas / and liquid petroleum facilities in accordance with 49 CFR 192 & 195. The Feds cannot enforce state one call laws and cannot enforce federal laws on non-federally regulated facilities, this distinction is addressed in the 10th Amendment of the US Constitution.     Thanks for the information, but according to section 60114 paragraph (f) if the state is deemed to not be operating in a safe manner, then the government can Step in.

    This would be to protect the environment and the natural gas. Aren't all gas lines supposed to be regulated federally?

    I locate NWN in Oregon and we are subject to random drug screenings and audits as part of the federal regulations.
